IMPORTANT SAFETY INFORMATION
IN ANY CHOKING EMERGENCY, CALL 911 IMMEDIATELY. The NovaCare Anti-Choking Device is an FDA-registered Class I medical device designed as a supplemental airway clearance tool to be used while awaiting emergency medical services. This device is not a substitute for standard choking protocols, emergency services, CPR, or the Heimlich maneuver. Product effectiveness depends on proper usage, adequate facial seal, and individual factors including age, facial anatomy, and presence of facial hair. Results may vary. Not guaranteed effective in all situations. Users must follow all included instructions and warnings.

WARRANTY AND RETURNS
Unless expressly provided in a written warranty or return policy offered by Top C Group LLC, the product is provided without warranties to the maximum extent permitted by law.
Your remedy for dissatisfaction with the product is limited to the remedies expressly provided in our posted return policy.

INDEMNIFICATION
You agree to indemnify and hold harmless Top C Group LLC and its officers, directors, employees, and agents from claims, damages, losses, liabilities, and expenses, including reasonable attorney fees, arising out of:

Your misuse of the product

Your failure to follow instructions and warnings

Your violation of these terms

Your unlawful acts or omissions involving the product

THIRD PARTY STATEMENTS AND UNAUTHORIZED SELLERS
Top C Group LLC is not responsible for statements made by third parties, including influencers, affiliates, reviewers, forums, or unauthorized sellers. Only information published by Top C Group LLC through official channels should be treated as official.

BINDING INDIVIDUAL ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ CAREFULLY. YOU ARE AGREEING TO RESOLVE DISPUTES BY ARBITRATION AND TO WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Any dispute, claim, or controversy arising out of or relating to the product, your purchase, your use, the website, or these terms shall be resolved by binding individual arbitration rather than in court, except you may bring an individual claim in small claims court if it qualifies.

Arbitration will be conducted on an individual basis only. You and Top C Group LLC agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, private attorney general, or representative proceeding.

Opt out right. You may opt out of arbitration within 30 days of purchase by emailing support@novacareus.com with your name and order number and a clear statement that you are opting out of arbitration. If you opt out, the class action waiver still applies to the maximum extent permitted by law.

This arbitration agreement is governed by the Federal Arbitration Act.

TIME LIMIT TO BRING CLAIMS
To the maximum extent permitted by law, any claim must be brought within one year after the event giving rise to the claim occurred, or it is permanently barred.

GOVERNING LAW AND VENUE
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles, except that the arbitration section is governed by the Federal Arbitration Act.
If a dispute is found not subject to arbitration, the parties consent to exclusive jurisdiction in the state and federal courts located in Delaware.

SEVERABILITY
If any provision of these terms is found unenforceable, the remainder will remain in full force and effect, and the unenforceable provision will be enforced to the maximum extent permitted by law.

CHANGES TO THESE TERMS
Top C Group LLC may update these terms at any time by posting an updated version with a new Last Updated date. Continued use of the product or website after changes are posted constitutes acceptance.
